1. Introduction
These Terms of Service govern the relationship between MAXFILMS STRZEPKA, trading as Recap Media (org. nr. 928 325 261, "we", "us", or "the Company"), and clients who engage our event photography, videography, and livestreaming services.
By booking our services — whether through written confirmation, invoice acceptance, or deposit payment — you agree to these terms. Please read them carefully before engaging our services.
2. Booking and Contract Formation
A binding agreement is formed when:
- You accept a written quote or proposal from us in writing (email confirmation is sufficient), and
- You pay the agreed deposit (see Section 4)
Until both conditions are met, we cannot guarantee availability on your event date. We recommend confirming your booking as early as possible.
All booking details — including event date, location, services, deliverables, and fees — are set out in the proposal. Any changes to the agreed scope must be confirmed in writing by both parties.
3. Services
We provide event photography, videography, and livestreaming services as described in the agreed proposal. Services may include:
- On-site photography and/or videography
- Multi-camera livestreaming
- Edited photo and video deliverables
- Social media content (vertical clips, short-form video)
- Artist interviews and documentary-style footage
We will make all reasonable efforts to deliver the agreed services. In the event of circumstances beyond our control (force majeure, illness, equipment failure), we will notify you promptly and propose solutions — including substitute crew or rescheduling.
4. Payment Terms
Deposit: A non-refundable deposit of 30% of the total project fee is required to confirm the booking and secure the date. The deposit is payable within 5 business days of accepting the proposal.
Balance: The remaining balance is invoiced upon delivery of the final deliverables and is due within 14 days of the invoice date.
Late payment: Overdue invoices may incur interest charges in accordance with the Norwegian Act on Interest on Overdue Payments (Forsinkelsesrenteloven). We reserve the right to withhold delivery of materials until full payment is received.
All prices are quoted in Norwegian Krone (NOK) and are exclusive of VAT unless otherwise stated. VAT will be added where applicable.
5. Cancellation Policy
Cancellations must be made in writing (email is sufficient). The following cancellation fees apply:
- More than 30 days before the event: Deposit forfeited; no further charge
- 15–30 days before the event: 50% of the total project fee
- Less than 15 days before the event: 100% of the total project fee
If we are required to cancel due to circumstances within our control, we will provide a full refund of all payments received, including the deposit. This is the limit of our liability in such cases.
6. Intellectual Property and Usage Rights
Copyright: MAXFILMS STRZEPKA retains copyright ownership of all photographs and video content produced under this agreement.
Usage licence: Upon receipt of full payment, the client is granted a non-exclusive, non-transferable licence to use the delivered materials for the purposes agreed in the proposal (typically: digital publication, social media, website, internal use, press). The scope of the licence is described in the proposal.
Portfolio use: We reserve the right to use delivered materials in our own portfolio, website, and promotional materials, unless otherwise agreed in writing prior to the event.
Third-party content: If any third-party materials (music, logos, branded content) are incorporated at the client's request, the client is responsible for obtaining the necessary rights and licences.
7. Deliverables and Turnaround
Deliverables and turnaround times are as agreed in the proposal. Standard turnaround is 5–7 business days. Expedited turnaround (24-hour, same-day) is available at additional cost and must be agreed before the event.
Delivered materials are provided via digital gallery or file transfer. We are not responsible for storing raw files beyond 60 days after delivery.
8. Client Responsibilities
To enable us to deliver the agreed services, the client agrees to:
- Provide accurate event details (date, time, location, schedule) in advance
- Ensure we have appropriate access to the venue and any restricted areas needed for coverage
- Notify us of any relevant restrictions (photography restrictions, confidentiality requirements, dress codes)
- Respond to pre-event briefing questions in a timely manner
9. Limitation of Liability
Our total liability to you in connection with any project shall not exceed the total fees paid by you for that project.
We are not liable for losses arising from: circumstances beyond our reasonable control; failure to capture specific moments due to access restrictions or timing; technical issues with third-party platforms (streaming services, social media); or client-provided content that infringes third-party rights.
10. Governing Law
These Terms of Service are governed by Norwegian law. Any disputes arising from or in connection with these terms will be subject to the jurisdiction of the Oslo District Court (Oslo tingrett), unless agreed otherwise.
